ARTICLE I – NAME

    This Local shall be known as Local 7011, Communications Workers of America

 

ARTICLE II – JURISDICTION

    Jurisdiction of the Local shall be the jurisdiction assigned by the Union and appearing on the Local Charter.

 

ARTICLE III – OBJECTIVE

    The objective of Local 7011 shall be to represent and serve the workers within its jurisdiction in accordance with the Bylaws and    Rules of the Local and Constitution and Policies of the Union.

 

ARTICLE IV – STRUCTURE, EXECUTIVE BOARD AND GOVERNING                   AUTHORITY

   

    SECTION 1 – LOCAL STRUCTURE

        The structure of the Local shall consist of the following:

A.    Membership

B.    Executive Board

C.    Committees

D.    Stewards

 

    SECTION 2 – LOCAL EXECUTIVE BOARD

        The Local Executive Board shall consist of the following:

A.    Local President

B.    Local Executive Vice President

C.    Local Secretary-Treasurer

D.    Two Vice Presidents to represent the Qwest inside workforces, with constituency divided as equitably as possible, consideration given to departments and numbers of members working in these inside departments.

E.     Beginning with the Election of New Officers in the year 2000, one Vice President to represent the Qwest Outside workforces and the Avaya membership. (Formerly Lucent Technologies)

F.     Upon Membership approval, an additional Local Vice president for each bargaining unit newly affiliated.

G.    In the event that a merger or an organizing effort results in the addition of 100 members or more a new position on the Executive Board will be established.

 

    SECTION 3 – GOVERNING AUTHORITY

    The affairs of this Local shall be governed by its membership in accordance with these Bylaws, Rules of the Local and the Constitution and Policies of the Union in the following manner:

A.  Through actions taken in membership meetings or by referenda of the                      

      membership.

B. Through actions and decisions of the Local Executive Board between    

                membership meetings.

C. The actions and decisions of the Local Executive Board between Local     

      meetings may be overruled by the membership at the next scheduled

      Local meeting after the action was taken, or by a mailed secret ballot      

      referendum of the membership.

 

ARTICLE V – MEMBERSHIP

 

    SECTION 1 – ELIGIBILITY

Any person eligible for membership in the Communications Workers of America, as defined in Article V of its Constitution, shall be eligible for membership in this Local, or performing work within the Local’s assigned jurisdiction, or if employed on a part-time or full0time basis by the Union.

 

    SECTION 2 – APPLICATION           

   A. Initiation Fee For All Sectors Excluding Broadcast

Upon application, Membership in the Local shall be obtained after payment or suspension of the Local initiation fee of $2.00 except for persons who are expelled from the Local because of not meeting their financial obligations to the Local.  They shall pay an initiation fee of $5.00.  The Membership Committee is authorized to accept or reject membership on behalf of the Local, subject to the right of the Local to overrule the decision of the Membership Committee. 

            B. Initiation Fee For Broadcast Sector (NABET)

  1. Upon receipt of a signed authorization of the Employee involved on a form approved by the Union and the Company, the Company will deduct from the Employee’s paycheck the required initiation fee and monthly dues payable by the Employee to the Union. It is agreed that the Company shall make the appropriate deductions from each paycheck of said Employee for the monthly dues. In addition to the dues, the Company shall deduct one tenth (1/10) of the designated initiation fee from each of the first ten (10) pay periods following the Employee’s first thirty (30) days of employment. Deductions for the initiation fees and Union dues shall be remitted to the International Office of the Union 501 Third Street, N. W., Washington, D.C. 20001 no later than the twentieth (20th) day of the month following the deductions and shall include all deductions made in the previous month. At the time of remittance, the Company will furnish the International Union and the Local Union with an alphabetical record of all Employees for whom deductions have been made, including gross earnings of each Employee for the period and the total amount of deductions for each Employee.

  2. During the term of this agreement, the Union agrees that the initiation fee for the employees hired on or after June 1, 2000 shall not exceed $150.00 for full time employees (i.e.,forty (40) hours per week) and $75.00 for part-time employees (i.e.,less than forty (40) hours per week). Whether the Employee pays directly or voluntarily elects to authorize the Company to make the deductions from his/her paycheck, the initiation fee shall be paid in equal installments during the first ten (10) pay periods following the Employee’s first thirty (30) days of employment.

    SECTION 3 – TRANSFERS

        The transfer of membership from the Local to the jurisdiction of another local and from another Local to the jurisdiction of this Local shall be made n accordance with Article X of the Union’s Constitution.

 

    SECTION 4 – RESIGNATIONS

        Any member may resign from membership in this Local in accordance to Article 5, section 4 of the CWA Constitution.

 

ARTICLE VI – LOCAL DUES AND ASSESSMENTS
 

    SECTION 1 – LOCAL DUES

            A.     All Sectors Excluding Broadcast

Each member of the Local shall pay membership dues in the amount of two and a quarter (2.25) hours pay per month based on a forty (40) hour week work schedule or $11.00 per month, whichever is greater.  Membership dues may be increased by a majority of those voting in a mailed secret ballot referendum of the membership of the membership or by a majority of those voting by secret ballot in a membership meeting, provided the question has been advertised on the Local’s bulletin boards at least seven (7) days in advance of the meeting or by mailed notice to each member at least seven (7) days in advance of the meeting.

B.     Broadcast Sector 

        International Dues

International Dues as outlined in Section 12.2 of the NABET-CWA By-Laws shall be one and two-thirds percent (1.67%) of total income, which shall include, but shall not be limited to, base pay, overtime pay, and penalties . This amount shall be collected by the Local Treasurer and paid to the Sector Secretary-Treasurer of NABET-CWA, except where check-off for International Dues is in effect.

                Local Dues-Optional Dues Refund Plan 

Sixty percent (60%) of International Dues paid by Local 7011 members shall be rebated to Local 7011 in accordance with Article XXII, Plan #1 of the NABET-CWA By-Laws.

    SECTION 2 – LOCAL ASSESSMENTS

        The members of this Local may levy a special assessment only in the same manner provided for changing local dues; However, any special assessments levied shall be in compliance with Article VI of the Union’s Constitution. 

 
ARTICLE VII – LOCAL MEETINGS

 

    SECTION 1 – MEMBERSHIP MEETINGS

A.    Normally a General Business Meeting of Membership shall be held on the Second Tuesday of each month.  Should a holiday or other community event fall on a regularly scheduled membership meeting date, the Executive Board may schedule another date provided such rescheduling was approved by the membership.

B.    The Local President shall call a special meeting within ten (10) days when directed to do so by a majority of the Executive Board or by a petition signed by ten percent (10%) of the membership.  A special meeting shall deal only with the issues(s) for which it was called.

    SECTION 2 – EXECUTIVE BOARD MEETINGS

The Local Executive Board shall meet at lease once each month.  Actions and decisions made at Local Executive Board Meetings shall be reported at the next scheduled membership meeting.

ARTICLE VIII  - LOCAL DELEGATES TO THE INTERNATIONAL CONVENTION

 

1.               The Local President, the Local Executive Vice President and the Local Secretary-Treasurer, by virtue of their election, may attend all Union Conventions scheduled during their term of office as the Local’s delegation with expenses consistent with the Rules of the Local. The fact the principal local offers are concurrently candidates to serve as delegates to the Union Convention shall be stated on the election ballot.  However, the number of delegates may be reduced by Local Executive Board or membership action.  In the event the number of delegates to a Union Convention is reduced to one or two, the Local President shall determine which of the principal officers shall attend and chair the delegation subject to the approval of the Local Executive Board.

 

2.               It shall be the duty of the Secretary-Treasurer of the Local to certify the Local Delegates to the Union Convention to the Secretary-Treasurer of the Union within the time limits specified in Article VIII of the Union’s Constitution. 

 

ARTICLE IX – LOCAL COMMITTEES

 

    SECTION 1 – REGULAR AND SPECIAL COMMITTEES

  1. The Local shall have the following regular committees:
    1. Membership Committee
    2. Legislative/COPE Committee
    3. Organizing Committee
    4. Election Committee
    5. Education committee
    6. Community Services Committee
    7. Audit Committee
    8. Bylaws Committee
    9. Equity Committee
    10. Newsletter Committee
    11. Mobilization Committee

 

  1. Members of all committees shall be appointed by the President with the approval of the Local Executive Board.

 

  1. Each Committee shall submit written report of its activities to the Local Executive Board prior to reporting to the membership.

 

  1. Vacancies on a committee shall be filled for the remainder of the unexpired term in the dame manner as the original appointments.

 

  1. A member of any Local committee may be removed by a majority vote of the Local Executive Board.  A committee member may also be removed by action of the Local in a membership meeting.

 

  1. Special committees may be appointed as the need arises in the same manner as provided in Article ix, section 1, paragraph B.G.  The term for which committee members serve may be three (3) years beginning February 1st to the following each Election year.

 

SECTION 2 – DUTIES OF COMMITTEES

 

A.    MEMBERSHIP COMMITTEE:

The Membership Committee consisting of the Local Executive Board shall accept or reject membership applications in accordance with the Bylaws and Rules of this local, Article V of the CWA Constitution and Policies of the Union.

B.    LEGISLATI VE COMMITTEE:

The Legislative Committee shall assist in developing and pursuing the programs of the Union and the Local in the legislative field.  It shall be responsible for the Local’s program to register each qualified voter.

   C.  ORGANIZING COMMITTEE:

The Organizing Committee shall assist the Local Executive Board and members in organizing all non-union employees within the Local’s jurisdiction. 

          D.  ELECTION COMMITTEE:

The Election Committee shall conduct al nominations and elections and referenda of this Local consistent with the Union’s Constitution and Policies, These Bylaws and Rules of the Local.  A committee member accepting nominations for the Local office shall be temporarily excused form service on the committee.

           E.  EDUCATION COMMITTEE:

The Education Committee shall assist in developing the Local’s education programs, and with the Local Executive Board, be responsible for effectuating the Union’s and the Local’s educational programs.

           F.  COMMUNITY SERVICES COMMITTEE:

The Community Services Committee shall assist in developing all community services programs

G.  AUDIT COMMITTEE:

The Audit Committee shall review monthly the financial records of the Local.  The Local Secretary-Treasurer shall serve as an ex-officio member of this committee.

H.  BYLAWS COMMITTEE:

The Bylaws Committee consisting of the Local Executive Board shall review all proposed amendments to these Local Bylaws, determine their impact on the Local Union and provide a recommendation to the Local membership for each proposed amendments it receives.  It shall present for membership action only proposed amendments which are deemed consistent with these Bylaws and the Union’s Constitution.

            I.  EQUITY COMMITTEE:

The Equity Committee shall study and report to the Local Executive Board and the Local membership on ways and means of eliminating discrimination on the basis of sex, race or any other bias.

            J.  MOBILIZATION COMMITTEE:

The mobilization Committee shall assist in developing and pursuing the programs of the Union and the Local in the mobilization of the membership.  It shall be responsible for the Local Mobilization structure to better effectuate the programs of the Union and Local.

ARTICLE X – ORDER OF BUSINESS

 

1.The order of business at a Local Membership Meeting shall be as follows:

        2. The order of business may be suspended by a two-third (2/3) vote of the members present.

 

ARTICLE XI – LOCAL OFFICERS, STEWARDS AND OTHER DUTIES

 

    SECTION 1 – PRESIDENT

        The Local President shall:

A.    Be responsible for the conduct of all Local business;

B.    Preside over all Local membership and Local Executive Board Meetings;

C.    Cause the prosecution of grievances and appeal them to the higher levels of the Union when not satisfactorily settled;

D.    Give direction to all committees;

E.     Be an ex-officio member of all committees

F.     Approve al bills to be paid and countersign all checks drawn on the Local treasury;

G.    Be responsible for enforcing these Bylaws;

H.    Be responsible for effecting all programs of the Local and the Union;

I.       Approve Stewards and Area Representatives appointments subject to 

      the approval of the Local Executive Board.

J.   Appoint committee members and committee chairpersons subject to   

     the approval of the Local Executive Board;

K.  Be empowered to establish special committees as the need for them 

      arise;

L.  Appoint to fill vacancies on the Local Executive Board for the

     remainder of the unexpired term; subject to the approval of the Local

     Executive Board.

M.  Be bonded by the Local for the faithful discharge of fiscal

      responsibilities in accordance with the Union constitution or State or

      Federal law; and

N.  Perform such additional duties as may be assigned by the Local

      Membership, the Local Executive Board and those required to be performed by these Bylaws, rules of the Local and the    Constitution of the Union.

 

    SECTION 2 – LOCAL EXECUTIVE VICE PRESIDENT

        The Local Executive Vice President shall:

  1. Work under the direction of the Local President;

  2. Be bonded by the Local for the faithful discharge of fiscal responsibilities in accordance with the Union     Constitution or State or Federal law;  and

  3. Perform such additional duties as may be assigned by the Local membership, the Local President or the Local Executive   Board and those required to be performed by these Bylaws, rules of the Local and the Constitution of the Union     

       SECTION 3 – LOCAL SECRETARY-TREASURER

            The Local Secretary-Treasurer shall:

  1. Maintain a record of the Local Membership;
  2. Be responsible for maintaining records of minutes and actions taken at Local membership and Local Executive Board meetings;
  3. Furnish the District Vice President and Secretary-Treasurer of the Union with copies of any changes in these Bylaws within ten (10) days after such changes are adopted;
  4. Certify the Local Delegates to the Union Convention to the Secretary-treasurer of the Union within the time limits specified in Article VIII of the Union Constitution.
  5. Be custodian of all records and assets of the Local;
  6. Submit to the Local Executive Board and Local membership a monthly financial statement, also submit a UAN report of all Union Representatives for the previous month by name and include cumulative within the current year.
  7. Cause the deposit and disbursement of the Local’s funds in accordance with the Local’s Rules’
  8. Cause the proper filing of al reports for filings required by Federal, State or Local laws;
  9. Propose a budget for the Local Executive Board and Local membership approval for each succeeding fiscal year;
  10. Serve as ex-officio member of the Audit Committee;
  11. Be bonded by the Local for the faithful discharge of fiscal responsibilities in accordance with the Union’s Constitution or State or Federal law; and
  12. Perform such additional duties as may be assigned by the Local membership, the Local President, the Local Executive board and those required to be performed by these Bylaws, Rules of the Local and the Constitution of the Union;

    SECTION 4 – LOCAL VICE PRESIDENTS

        The Local Vice President’s shall: 

  1. Effectuate all Local and Union programs in their area of responsibility;
  2. Appoint Stewards and Area Representatives for service within their assigned area of responsibility, subject to the approval of the Local President;
  3. Cause the prosecution of grievances within their area of responsibility; and
  4. Perform such additional duties as may be assigned by the Local membership, the Local President and the Local Executive Board and those required to be performed by these Bylaws, Rules of the Local and the Constitution of the Union.

    SECTION 5 – LOCAL EXECUTIVE BOARD

        The Local Executive Board shall:

  1. Act on the appointment of the Local President;
  2. Determine the number of delegates which may attend a Union Convention and recommend same to the Local membership
  3. Recommend to the Local membership delegates to all meetings and conferences which are beneficial to the local; and
  4. Establish Local Rules and Financial Policies in conformity with the Union Constitution and these Bylaws.

    SECTION 6 – LOCAL AREA REPRESENTATIVES AND LOCAL STEWARDS 

   A.  LOCAL AREA REPRESENTATIVES

        The Local Area Representative shall:

    1. Work under the direction of the Local President and the Local Vice President;
    2. Effectuate all Local and Union programs in their assigned area of responsibility;
    3. Direct the efforts of local stewards within their assigned area of responsibility;
    4. Cause the prosecution of grievances within their assigned area of responsibility.

     B.  LOCAL STEWARDS

The Local Stewards shall:

  1.  Work under the direction of the Local President, Local Vice President and Area Representative;

  2. Effectuate all Local and Union programs in their assigned area of responsibility;

  3.  Prosecute grievances within their assigned area of responsibility; and

  4. Perform additional duties as may be assigned by the Local President, the Local Vice President or the Local Area Representative.

                       C.  Local Area Representatives and Local Stewards may be removed from service by the Local Executive Board when it determines their duties are not being performed satisfactorily.

D.  The term for which Local Area Representatives and Local Stewards may serve shall be three (3) years beginning February 1st of the year following each election year.

  1. Local Area Representatives and Local Steward vacancies shall be fi8lled for the remainder of the unexpired term in the same manner as the original appointments.

    SECTION 7 – UAN TIME

  1. All UAN time paid or unpaid shall be recorded on a voucher.
  1. Shall only be used for official Union business.

ARTICLE XII – AUTOMATIC REMOVAL FROM LOCAL UNION RESPONSIBILITY

 

1.              Any member serving as an Officer, Area Representative, Steward or Change Agent, who accepts a position as a relief or acting management shall be considered as having resigned from their position.

2.              The acceptance of a position as a relief or acting management during the election process shall cause a candidate running for Local office to be automatically disqualified from candidacy.

 
ARTICLE XIII – CONDUCT OF BUSINESS AND QUORUM

 

    1. Membership meetings and any other business of the Local shall be conducted under these Bylaws and rules of the Local and in conformity with the Union Constitution.  On questions where the Local Bylaws the Local Rules or the Union constitution do not clearly apply, Roberts Rules of Order shall govern.
    2. The number constituting a quorum for Local meetings shall be twenty (20).
    3. A majority of the members of the Local Executive Board, and a majority of the members of a committee shall constitute a quorum for those bodies.
    4. In consideration of the health of our members, there shall be no smoking in the Local Union Hall during the conduct of the monthly membership meeting.
    5. In the event there is not a quorum for the monthly membership meeting, actions that were taken at the Executive Board meeting shall be binding.

 

ARTICLE XIV – NOMINATIONS AND ELECTIONS
 

    SECTION 1 – NOMINATIONS

  1.  Nominations shall take place at a regular membership meeting during the 

       month of September of each election year. 

 

  2. Notice of nominations shall be given to the membership at least fifteen (15)

      days in advance of the Local Membership Meeting scheduled for such

      purpose.  Such notice shall be provided prominently in the Local’s newsletter

      or by U.S. Mail sent to each member’s last known address. The

      announcement of nominations will also be posted on all Union Boards.  

 

3.  Only members in good standing may be nominated for Local Executive Board

     Office, provided the nominee has currently held continuous membership in

     CWA for at least one year. Any member in good standing may make the 

     nomination.

4.   The Election Committee shall conduct nominations for Local Offices consistent with the CWA Constitution, the Local Bylaws and Rules of the Local.  Should a member of the Election Committee be nominated for Local Office and accept such nomination, the Committee Person shall be excused from Election Committee service and be replaced by another member. 

5.  The order in which nominations shall be taken shall be: Local President and CWA Convention Delegate; Local Executive Vice President and CWA Convention Delegate; Local Secretary-Treasurer and CWA Convention Delegate; to be followed by the Local Vice Presidents. Nominees accepting candidacy for Local Office must do so at the meeting for which nominations were held.  Should a nominee be absent from said meeting, written acceptance shall be required and furnished at the meeting. 

6.  If only one nominee is presented for an office, seconded, and accepted

     by the nominee, the nominee shall be declared “Elected by Acclamation”.

     The nominee’s name shall appear on the ballot with an “unopposed”

     designation. 

    SECTION 2 – ELECTIONS

 

A.  Elections of Local Executive Board members shall be by mailed secret ballot referendum of the membership in the month of October of each election year.  All Members will vote for the Local President, Executive Vice-President, Secretary-Treasurer, and the Vice-President’s position representing their work group.

 

B. The candidate receiving the majority of the votes cast for each office shall be declared elected.

 

C. If the positions for Local President, Local Executive Vice President, Secretary-Treasurer, and a Vice President for a specific work group or sector are ALL UN-OPPOSED, that work group will not receive a ballot. The election committee will insure that flyers are posted at ALL the work sites of this group advising them of the “Election by Acclamation.”

 

    SECTION 3 – GENERAL PROVISIONS

A.    The term of office shall be for three (3) years or until a successor has been duly qualified and elected.

B.    The Local Officers shall take office at the regular Membership Meeting in December of each election year.

 

    SECTION 4 – VACANCIES

A.    A vacancy in the office of Local President shall be assumed immediately by the Local Executive Vice President until a successor Local President has been elected and qualified. The election process shall be started within twenty (20) days of vacancy of the office.

B.    Vacancies in other Local offices, if the remaining term is twelve (12) months or less, shall be filled by appointment of the Local President with approval of the Local Executive Board. Vacancies with more than twelve (12) months remaining in the term shall be filled by an election. The election process shall be started within twenty (20) days of created vacancy. 

 
ARTICLE XV – STRIKES

 

A. The calling, conduct and termination of strikes affecting this Local at all times

     be carried on in compliance with the Rules prescribed by the Union and Article

     XVIII of its Constitution.

 

 B. The Strike Fund

 

1. The strike fund was established to provide financial assistance to the Membership during an authorized strike.

 

2. The Executive Board shall determine the amount of funds to be transferred monthly into the strike fund.

 

3. The Executive Board shall establish the guidelines for distribution of funds to the Membership during an authorized strike.

 

4. Approval for disbursement of money from the strike fund

for any purpose other than an authorized strike shall be by

secret referendum of the membership. 

 
ARTICLE XVI – CHARGES, TRIALS AND APPEALS 

SECTION 1 – CHARGES

Any charges, Trials and/or appeals will be handled as outlined in the current Constitution. 

ARTICLE XVII – RECALL OF LOCAL OFFICERS 

Any recall of Local Officers will be handled as outlined in the current Constitution.

ARTICLE XVIII – REFERENDUM OF THE LOCAL
 

1.     The Local Election Committee shall submit any question to a mailed secret ballot referendum of the membership as required by these Bylaws and when directed to do so by action of a regular or special membership meeting.

2.     Questions submitted to a mailed secret ballot referendum of the membership shall be determined by a majority of those voting on the question.

 

ARTICLE XIX – FISCAL YEAR AND AUDIT
 
    1. The fiscal year of this Local shall be from October 1st of each year to and including September 30 of the succeeding year.
    2. The financial records of the Local shall be audited annually by an  expanded Audit Committee at the end of each fiscal year.  This committee will consist of the entire audit Committee and the “Local Vice President’s”.  The result of such audit shall be made available for the inspection of any member of the Local.

 

ARTICLE XX – OATH OF OFFICE

 

    Each elected Officer of the Local, after meeting all other qualifications, shall be duly installed upon taking the following oath:

 

“I (give name) hereby accept the office of (name of office) of Local 7011, Communications Workers of America, with full knowledge of the responsibilities and duties of such office.”

 

“I promise to faithfully discharge my duties according to the Bylaws and Rules of the Local and the Constitution and Policies of the Union.”

 

“I further promise to give my successor in office all books and records in my possession.  I shall at all times endeavor to serve my Local and the union to the best of my ability, so help me God.”

 

ARTICLE XXI – ADOPTION

 

    After adoption, these Bylaws may be amended quarterly (In January, April, July &  October).

 

ARTICLE XXII – AMENDMENTS TO LOCAL BYLAWS

 

    Proposed Bylaw changes or amendments must be submitted in writing and signed no latter than forty (40) days prior to the date of the membership meeting that will vote on said proposed changes. Upon receipt of proposed changes or amendments, their acceptance will be determined by:

 

A.    A majority vote of the members present at a regular or special membership meeting provided the membership meeting which shall consider proposed amendments was so advertised to the membership at lease seven (7) days in advance of the meeting by use of the Local Newsletter, bulletin boards, or US Mail; or by a majority of votes cast referendum of the membership.

 

B.    Proposed amendments dealing with changes in membership dues or

                 initiation fees shall be voted upon by secret ballot only.

 

C.    The Bylaws Committee shall provide the membership its   

recommendation for each proposed amendment.
