ARTICLE I – NAME

      This Local shall be known as Local 7011, Communications Workers of America

ARTICLE II – JURISDICTION

      Jurisdiction of the Local shall be the jurisdiction assigned by the Union and appearing on the Local Charter.

ARTICLE III – OBJECTIVE

      The objective of Local 7011 shall be to represent and serve the workers within its jurisdiction in accordance with the Bylaws and Rules of the Local and Constitution and Policies of the Union.

ARTICLE IV – STRUCTURE, LOCAL EXECUTIVE BOARD & GOVERNING AUTHORITY

SECTION 1- STRUCTURE

The structure of the Local shall consist of the following:

A. Membership

B. Executive Board

C. Committees

SECTION 2 – LOCAL EXECUTIVE BOARD

The Local Executive Board shall consist of the following:

A. Local President 

B. Local Executive Vice President

C. Local Secretary-Treasurer

D. Vice Presidents

E. Any event that results in a significant increase or

decrease in the membership shall be addressed by

the Executive Board. They shall determine whether

a re-alignment of the current VP's responsibilities,

eliminating or creating a new Vice President’s

position would be the appropriate action. They shall

present their recommendation to the membership.

SECTION 3 – GOVERNING AUTHORITY

      The affairs of this Local shall be governed by

its membership in accordance with these Bylaws,

Rules of the Local and the Constitution and Policies

of the Union in the following manner:

A. Through actions taken in membership meetings or

by referenda of the membership.

B. Through actions and decisions of the Local 

Executive Board between membership meetings.

C. The actions and decisions of the Local Executive

Board between Local meetings may be overruled

by the membership at the next Local membership

meeting after the action was taken, or by a mailed

secret ballot referendum of the membership.

ARTICLE V – MEMBERSHIP

SECTION 1 – ELIGIBILITY

      Any person eligible for membership in the Communications Workers of America, as defined in Article V of its Constitution, shall be eligible for membership in this Local, or performing work within the Local’s assigned jurisdiction, or if employed on a part-time or full time basis by the Union.

SECTION 2 – APPLICATION

A. Initiation Fee

Upon application, Membership in the Local shall

be obtained after payment or suspension of the Local

initiation fee of $2.00 except for persons who are

expelled from the Local because of not meeting their

financial obligations to the Local. They shall pay an

initiation fee of 5.00.The Membership Committee is

authorized to accept or reject membership on behalf

of the Local, subject to the right of the Local to

overrule the decision of the Membership Committee.

SECTION 3 – TRANSFERS

      The transfer of membership from the Local to the jurisdiction of another local and from another Local to the jurisdiction of this Local shall be made in accordance with Article X of the Union’s Constitution.

SECTION 4 – RESIGNATIONS

      Any member may resign from membership in this Local in accordance to Article 5, section 4 of the CWA Constitution.

ARTICLE VI – LOCAL DUES AND ASSESSMENTS

SECTION 1 – LOCAL DUES

      Each member of the Local shall pay membership dues in the amount of two and a quarter (2.25) hours pay per month based on a forty (40) hour week work schedule or $11.00 per month, whichever is greater. Membership dues may be increased by a majority of those voting in a mailed secret ballot referendum of the membership of the membership or by a majority of those voting by secret ballot in a membership meeting, provided the question has been advertised on the Local’s bulletin boards at least seven (7) days in advance of the meeting or by mailed notice to each member at least seven (7) days in advance of the meeting. 

SECTION 2 – LOCAL ASSESSMENTS

      The members of this Local may levy a special assessment only in the same manner provided for changing local dues; However, any special assessments levied shall be in compliance with Article VI of the Union’s Constitution.

ARTICLE VII – LOCAL MEETINGS

SECTION 1 – MEMBERSHIP MEETINGS

A. Normally a General Business Meeting of

Membership shall be held on the Second Tuesday of

each month. Should a holiday or other community

event fall on a regularly scheduled membership

meeting date, the Executive Board may schedule

another date provided such rescheduling was

approved by the membership

B. The Local President shall call a special meeting

within ten (10) days when directed to do so by a

majority of the Executive Board or by a petition signed by ten percent (10%) of the membership. A special meeting shall deal only with the issues(s) for which it was called. 

SECTION 2 – EXECUTIVE BOARD MEETINGS

      The Local Executive Board shall meet at least once each month. Actions and decisions made at Local Executive Board Meetings shall be reported at the next scheduled membership meeting.

ARTICLE VIII
LOCAL DELEGATES TO THE INTERNATIONAL CONVENTION

A. The Local President, the Local Executive Vice

President and the Local Secretary-Treasurer, by

virtue of their election, may attend all Union

Conventions scheduled during their term of office as

the Local’s delegation with expenses consistent with

the Rules of the Local. The fact the principal local

offers are concurrently candidates to serve as

delegates to the Union Convention shall be stated on

the election ballot. 

However, the number of delegates may be

reduced by Local Executive Board or membership

action. In the event the number of delegates to a

Union Convention is reduced to one or two, the Local

President shall determine which of the principal

officers shall attend and chair the delegation subject

to the approval of the Local Executive Board.

B. It shall be the duty of the Secretary-Treasurer of

the Local to certify the Local Delegates to the Union

Convention to the Secretary-Treasurer of the Union

within the time limits specified in Article VIII of the

Union’s Constitution.

ARTICLE IX – LOCAL COMMITTEES

SECTION 1 – REGULAR AND SPECIAL COMMITTEES

A. The Local shall have the following regular   

committees:

1. Membership Committee

2. Legislative/COPE Committee

3. Organizing Committee

4. Election Committee

5. Education committee 

6. Community Services Committee

7. Audit Committee

8. Bylaws Committee

9. Equity Committee

10. Newsletter Committee

11. Mobilization Committee

12. Bargaining Committee   

B. Members of all committees, excluding the   

Bargaining Committees, shall be appointed by  

the President with the approval of the Local   

Executive Board.

C. Each Committee shall submit written report of its

activities to the Local Executive Board prior to

reporting to the membership.

D. Vacancies on a committee shall be filled for t the

remainder of the unexpired term in the same

manner as the original appointments.

E. A member of any Local committee may be

removed by a majority vote of the Local Executive

Board. A committee member may also be removed

by action of the Local in a membership meeting.

F. Special committees may be appointed as the   

need arises in the same manner as provided in

Article IX, section 1, paragraph B.

G. The term for which committee members serve

may be three (3) years beginning February 1st to

the following each Election year.

H. The Local Executive Board shall determine the 

number of members that comprises each committee

SECTION 2 – DUTIES OF COMMITTEES

A. MEMBERSHIP COMMITTEE:

The Membership Committee consisting of the

Local Executive Board shall accept or reject

membership applications in accordance with the

Bylaws and Rules of this local, Article V of the CWA

Constitution and Policies of the Union.

B. LEGISLATIVE COMMITTEE:

The Legislative Committee shall assist in

developing and pursuing the programs of the Union

and the Local in the legislative field. It shall be

responsible for the Local’s program to register each

qualified voter.     

C. ORGANIZING COMMITTEE:

The Organizing Committee shall assist the

Local Executive Board and members in organizing all

non-union employees within the Local’s jurisdiction.

D. ELECTION COMMITTEE:

The Election Committee shall conduct all

nominations and elections and referenda of this

Local consistent with the Union’s Constitution and

Policies, these Bylaws and Rules of the Local.

E. EDUCATION COMMITTEE: 

The Education Committee shall assist in

developing the Local’s education programs, and with

the Local Executive Board, be responsible for

effectuating the Union’s and the Local’s educational

programs.

F. COMMUNITY SERVICES COMMITTEE: 

The Community Services Committee shall

assist in developing all community services

programs.

G. AUDIT COMMITTEE:

The Audit Committee shall review monthly the

financial records of the Local. The Local Secretary- 

Treasurer shall serve as an ex-officio member of

this committee.

H. BYLAWS COMMITTEE:     

The Bylaws Committee consisting of the

Local Executive Board shall review all proposed

amendments to these local Bylaws, determine their

impact on the Local Union and provide a

recommendation to the Local membership for each

proposed amendment it receives . It shall present

for membership action only proposed amendments

which are deemed consistent with these Bylaws

and the Union’s Constitution.

I. EQUITY COMMITTEE:     

The Equity Committee shall study and report to

the Local Executive Board and the local

membership on ways of eliminating discrimination

on the basis of sex, race or any other bias

J. MOBILIZATION COMMITTEE:   

The Mobilization Committee shall assist in

developing and pursuing the programs of the Union

and the Local in the mobilization of the

membership. It shall be responsible for the Local

Mobilization structure to better effectuate the

programs of the Union and Local.

KBARGAINING COMMITTEE:     

Members of each bargaining committee must

be employed within the unit they represent. Each

committee for a unit, for its full term of office, shall

be consulted in the negotiations of all agreements

entered into between the employer and the Union

that amends or augments the agreed upon

contract.

ARTICLE X – ORDER OF BUSINESS
A. The order of business at a Local Membership  

Meeting shall be as follows:

      1. Call to order

      2. Roll call (Optional)

      3. Reading and action of minutes of previous

meeting

      4. Report of Officers

      5. Report of Committees

      6. Unfinished Business

      7. New Business

      8. Good & Welfare

      9. Adjournment

B. The order of business may be suspended by a

two-third (2/3) vote of the members present.

ARTICLE XI – LOCAL OFFICERS, STEWARDS AND OTHER DUTIES

SECTION 1 – PRESIDENT

The Local President shall:

A. Be responsible for the conduct of all Local

business

B. Preside over all Local membership and Local

Executive Board Meetings

C. Cause the prosecution of grievances and appeal

them to the higher levels of the Union when not

satisfactorily settled

D. Give direction to all committees

E. Be an ex-officio member of all committees

F. Approve all bills to be paid and countersign all

checks drawn on the Local treasury

G. Be responsible for enforcing these Bylaws

H. Be responsible for effecting all programs of the

Local and the Union

I. Approve Stewards and Area Representatives

appointments subject to the approval of the Local

Executive Board.

J. Appoint committee members and committee

chairpersons subject to the approval of the Local

Executive Board

K. Be empowered to establish special committees as

the need for them arise

L. Be bonded by the Local for the faithful discharge 

of fiscal responsibilities in accordance with the 

Union Constitution or State or Federal law

M. Perform such additional duties as may be   

assigned by the Local Membership, the Local   

Executive Board and those required to be   

performed by these Bylaws, rules of the Local and 

the Constitution of the Union.

SECTION 2 – LOCAL EXECUTIVE VICE PRESIDENT

The Local Vice President shall:

A. Work under the direction of the Local President

B. Be bonded by the Local for the faithful discharge of

fiscal responsibilities in accordance with the Union

Constitution or State or Federal law

C. Perform such additional duties as may be assigned

by the Local membership, the Local President or

the Local Executive Board and those required to be

performed by these Bylaws, rules of the Local and

the Constitution of the Union.

SECTION 3 – LOCAL SECRETARY-TREASURER

The Local Secretary-Treasurer shall:

A. Maintain a record of the Local Membership.

B. Be responsible for maintaining records of minutes

and actions taken at Local membership and Local

Executive Board meetings.

C. Furnish the District Vice President and Secretary-

Treasurer of the Union with copies of any changes 

in these Bylaws within ten (10) days after such

changes are adopted.

D. Certify the Local Delegates to the Union

Convention to the Secretary-treasurer of the Union

within the time limits specified in Article VIII of the

Union Constitution.

E. Be custodian of all records and assets of the Local;

F. Submit to the Local Executive Board and Local 

membership a monthly financial statement, also

submit a UAN report of all Union Representatives

for the previous month by name and include

cumulative within the current year.

G. Cause the deposit and disbursement of the Local’s

funds in accordance with the Local’s Rules’

H. Cause the proper filing of all reports for filings

required by Federal, State or Local laws;

I. Propose a budget for the Local Executive Board

and Local membership approval for each

succeeding fiscal year;

J. Serve as ex-officio member of the Audit

Committee;

K. Be bonded by the Local for the faithful discharge of

fiscal responsibilities in accordance with the

Union’s Constitution or State or Federal law; and

L. Perform such additional duties as may be assigned

by the Local membership, the Local President, the

Local Executive board and those required to be

performed by these Bylaws, Rules of the Local and

the Constitution of the Union;

SECTION 4 – LOCAL VICE PRESIDENTS

The Local Vice President’s shall:

A. Effectuate all Local and Union programs in their

area of responsibility.

B. Appoint Stewards and Area Representatives for

service within their assigned area of responsibility,

subject to the approval of the Local President.

C. Cause the prosecution of grievances within their

area of responsibility.

D. Perform such additional duties as may be assigned

by the Local membership, the Local President and

the Local Executive Board and those required to 

be performed by these Bylaws, Rules of the Local

and the Constitution of the Union.

SECTION 5 – LOCAL EXECUTIVE BOARD

The Local Executive Board shall:

A. Act on the appointment of the Local President

B. Determine the number of delegates which may 

attend a Union Convention and recommend same

to the Local membership

C. Recommend to the Local membership delegates to

all meetings and conferences which are beneficial

to the Local.

D. Establish Local Rules and Financial Policies in

conformity  with the Union Constitution and these

Bylaws.

SECTION 6 – LOCAL AREA REPRESENTATIVES

AND LOCAL STEWARDS

A. LOCAL AREA REPRESENTATIVES

The Local Area Representative shall:

1. Work under the direction of the Local  President and the Local Vice President.

2. Effectuate all Local and Union programs in

 their assigned area of responsibility.

3. Direct the efforts of local stewards within their   assigned area of responsibility.

4. Cause the prosecution of grievances within

their assigned area of responsibility.

B. LOCAL STEWARDS

The Local Stewards shall:

1. Work under the direction of the Local     President, Local Vice President and Area  

Representative.

2. Effectuate all Local and Union programs in

their assigned area of responsibility.

3. Prosecute grievances within their assigned

area of responsibility.

4. Perform additional duties as may be assigned   by the Local President, the Local Vice

President or the Local Area Representative.

C. Local Area Representatives and Local Stewards

may be removed from service by the Local

Executive Board when it determines their duties

are  not being performed satisfactorily.

D. The term for which Local Area Representatives and

Local Stewards may serve shall be three (3) years

beginning February 1st of the year following each

election year.

E. Local Area Representatives and Local Steward

vacancies shall be filled for the remainder of the

unexpired term in the same manner as the original

appointments.

SECTION 7 – UNION PAID TIME

A. All Union paid time shall be recorded on a voucher.

B. Shall only be used for official Union business.

ARTICLE XII – AUTOMATIC REMOVAL FROM LOCAL UNION RESPONSIBILITY

A. Any member serving as an Officer, Area

Representative, Steward or Change Agent, who

accepts a position as a relief or acting

management shall be considered as having

resigned from their position.

B. The acceptance of a position as a relief or acting

management during the election process shall

cause a candidate running for Local office to be

automatically disqualified from candidacy.

ARTICLE XIII – CONDUCT OF BUSINESS AND QUORUM

A. Membership meetings and any other business of

the Local shall be conducted under these Bylaws

and rules of the Local and in conformity with the

Union Constitution. On questions where the Local’s

Bylaws the Local Rules or the Union Constitution

do not clearly apply, Roberts Rules of Order shall

govern.

B. The number constituting a quorum for a Local

meeting shall be those members present.

C. A majority of the members of the Local Executive

Board, and a majority of the members of a

committee shall constitute a quorum for those

bodies.

ARTICLE XIV – NOMINATIONS AND ELECTIONS

SECTION 1 - NOMINATIONS

A. Nominations shall take place at a regular

membership meeting during the month of

September of each election year. 

B. Notice of nominations shall be given to the

membership at least fifteen (15) days in advance of

the Local Membership Meeting scheduled for such

purpose. Such notice shall be provided prominently

in the Local’s newsletter or by U.S. Mail sent to

each member’s last known address. The

announcement of nominations will also be posted

on all Union Boards. 

C. All nominees must be members in good standing.

D. Nominees for the office of Local President, Local

Executive Vice President and Secretary-Treasurer

must also have held continuous membership in

CWA for at least one year. Any member in good

standing may make the nomination.

E. Vice President nominees must be employed within

the area of responsibility of the Vice President’s

position for which they desire to run as defined in

our Rules. Only members within each Vice

President’s area of responsibility may make the

nomination.

F. Should a member of the Election Committee

be nominated for Local Office and accept such

nomination, the Committee Person shall be

excused from Election Committee service and be

replaced by another member. 

G. The order in which nominations shall be taken shall

be: Local President and CWA Convention

Delegate; Local Executive Vice President and

CWA Convention Delegate; Local Secretary-

Treasurer and CWA Convention Delegate; to be

followed by  the Local Vice Presidents.

H. Nominees accepting candidacy for Local Office

must do so at the meeting for which nominations

were held. Should a nominee be absent from said

meeting, written acceptance shall be required and

furnished at the meeting. 

I. If only one nominee is presented for an office,

and accepted by the nominee, the nominee shall

be declared “Elected by Acclamation”. The

nominee’s name shall appear on  the ballot with an

“unopposed” designation.

SECTION 2 – ELECTIONS

A. The election committee shall follow the rules and

guidelines set forth in the CWA Constitution, “The

CWA Guide for Local Elections” and the

Department of Labor “Conducting Local Union

Officer Elections”.

B. Elections of Local Executive Board members shall

be by mailed Secret ballot referendum of the

membership beginning in the month of October of

each election year. All Members will vote for the

Local President, Executive Vice-President,

Secretary-Treasurer, and the Vice-President’s

position representing their work group.

C. The names of candidates on the ballot shall appear

in alphabetical order.

D. Only members in good standing, with a signed

membership card, may vote. Those members’

names will appear on the “Voter Eligibility List”. The

list shall be furnished by the Secretary-Treasurer.

E. The nominee for President, Executive Vice

President, Secretary-Treasurer and each VP

Position receiving the majority of votes cast shall

be  declared elected. If no one has the majority of

the  votes cast on the first ballot, the vote shall be

taken again and the two (2) nominees having the

greater number of votes on the first ballot shall be

the nominees on the second ballot.

F. If the positions for Local President, Local Executive

Vice President, Secretary-Treasurer, and a Vice

President for a specific work group or sector are

ALL UN-OPPOSED, that work group will not

receive a ballot. The election committee will insure

that flyers are posted at ALL the work sites of this

group advising them of the “Election by

Acclamation.”

G. Write-in voting shall not be permitted. 

H. Duplicate ballots shall be issued only when

requested by the member by contacting the Local

by telephone or appearing in person. A list of

members requesting duplicate ballots, with their

social security number and address shall be

maintained by the Local secretary and provided to

the Election Committee. Duplicate ballot envelopes

shall be stamped as such. A member of the

election committee will mail the requested duplicate

ballot.

I. If a duplicate and original ballot is returned by a

member, the envelope marked duplicate shall be

opened and counted. The original ballot will be

void.

J. Any challenge to the conduct of an election must be

filed in writing with the Election Committee within

ten (10) days of the tentative certification of the

results. Absent a challenge to the election, the

tentative certification shall become final ten (10)

days thereafter.

SECTION 3 – GENERAL PROVISIONS

A. The term of office shall be for three (3) years or

until a successor has been duly elected and

certified.

B. The Local Officers shall take office at the regular

Membership Meeting in December of each election

year.

SECTION 4 – VACANCIES

A. A vacancy in the office of Local President shall be

assumed immediately by the Local Executive Vice

President until a successor Local President has

been elected and certified. The election process

shall be completed within sixty (60) days.

B. Vacancies in all other Local offices

1. If the vacancy occurs within the first year of the

term, the vacancy shall be filled by election. The

election process shall be completed within

sixty (60) days.

2. Vacancies in the office of the Executive Vice   

President, or Secretary-Treasurer that occur  

after the first year of the term shall be filled  

either by an initial appointment by the Local  

President with approval of the Local Executive

Board and membership or by an election. The

election process shall be completed within sixty

(60) days.

3. Vacancies in the Vice President’s position that

occur after the first year of the term shall be  

filled either by an initial appointment by the

Local President with approval of the Local

Executive Board and membership represented

by that Sector, or by an election. The election

process shall be completed within sixty (60)

days.

4. The membership shall be notified of the   

appointment at the next general meeting. A vote

on that appointment, by the group being   

represented, shall take place at the next  

scheduled general meeting following notification

of the appointment.

C. The Local President, with the Executive Board

concurrence may appoint a member to temporarily

fill such a vacancy until the office is filled.

ARTICLE XV – STRIKES

A. The calling, conduct and termination of strikes

affecting this Local at all times be carried on in 

compliance with the Rules prescribed by the Union

and Article XVIII of its Constitution.

B. The Strike Fund

1. The strike fund was established to provide  

financial assistance to the Membership during

an authorized strike.

2. The Executive Board shall determine the  

amount of funds to be transferred monthly into

the strike fund.

3. The Executive Board shall establish the  

guidelines for distribution of funds to the  

Membership during an authorized strike.

4. Approval for disbursement of money from the

strike fund for any purpose other than an  

authorized strike shall be by secret referendum

of the membership.

ARTICLE XVI – CHARGES, TRIALS AND APPEALS

      Any charges, Trials and/or appeals will be handled as outlined in the current Constitution.

ARTICLE XVII – RECALL OF LOCAL OFFICERS

      Any recall of Local Officers will be handled as outlined in the current Constitution.

ARTICLE XVIII – REFERENDUM OF THE LOCAL

A. The Local Election Committee shall submit any

question to a mailed secret ballot referendum of the

membership as required by these Bylaws and 

when directed to do so by action of a regular or

special membership meeting.

B. Questions submitted to a mailed secret ballot

referendum of the membership shall be determined

by a majority of those voting on the question.

ARTICLE XIX – FISCAL YEAR AND AUDIT

A. The fiscal year of this Local shall be from October

1st of each year to and including September 30 of 

the succeeding year.

B. The financial records of the Local shall be audited

annually by an expanded Audit Committee at the

end of each fiscal year. This committee will consist

of the entire audit Committee and the “Local Vice

Presidents”. The result of such audit shall be made

available for the inspection of any member of the

Local.

ARTICLE XX – OATH OF OFFICE

      Each elected Officer of the Local, after meeting all other qualifications, shall be duly installed upon taking the following oath:

“I (give name) hereby accept the office of (name of office) of Local 7011, Communications Workers of America, with full knowledge of the responsibilities and duties of such office.”

“I promise to faithfully discharge my duties according to the Bylaws and Rules of the Local and the Constitution and Policies of the Union.”

“I further promise to give my successor in office all books and records in my possession. I shall at all times endeavor to serve my Local and the union to the best of my ability, so help me God.”

ARTICLE XXI – ADOPTION

      After adoption, these Bylaws may be amended quarterly (In January, April, July & October).

ARTICLE XXII – AMENDMENTS TO LOCAL BYLAWS
      Proposed Bylaw changes or amendments must be submitted in writing to the Local Secretary-Treasurer and signed no latter than forty (40) days prior to the date of the membership meeting that will vote on said proposed changes. Upon receipt of proposed changes or amendments, their acceptance will be determined by:

A. A majority vote of the members present at a regular

or special membership meeting provided the

membership meeting which shall consider

proposed amendments was so advertised to the

membership at least seven (7) days in advance of

the meeting by use of the Local Newsletter, bulletin

boards, or US Mail; or by a majority of votes cast

referendum of the membership.

B. Proposed amendments dealing with changes in

membership dues or initiation fees shall be voted

upon by secret ballot only.

C. The Bylaws Committee shall provide the

membership its’ recommendation for each

proposed amendment.
